Terms & Conditions

1. Scope and Acceptance

These Terms & Conditions (“Terms”) govern all purchases of Manta Foils products by any person or entity (“Customer”) from Manta Foils B.V. (“Manta Foils”, “we”, “us”, or “our”), including through our website, distributors, or direct sales. These Terms apply to both business-to-consumer (B2C) and business-to-business (B2B) transactions across all regions in which we operate.
By placing an order or purchasing a product, the Customer expressly agrees to be bound by these Terms. These Terms supersede any prior communications, representations, or agreements, whether oral or written. Any conflicting or additional terms provided by the Customer are hereby rejected and shall not apply unless expressly accepted in writing by Manta Foils.

2. Products Covered

Equipment Setup Disclaimer:

An eFoil or foil assist system must be used with appropriate board, foil, and propeller configurations to function as intended. The effectiveness of the system is highly dependent on proper equipment selection. For example, using a low-volume board (under 70 liters) with a rider weighing more than 80 kg typically requires a foil surface area greater than 1100 cm². Similarly, the shape and profile of the board and hydrofoil play a critical role in achieving sufficient lift and momentum. Manta Foils is not responsible if the product does not allow the rider to foil, as numerous factors—including board volume and shape, foil surface area, rider weight, water conditions, rider technique, and setup compatibility—affect performance. We recommend browsing reliable online sources or contacting our support team directly for guidance on selecting a proper foil setup tailored to your use case.
Images and product illustrations displayed on our website, in brochures, or on marketing materials are for informational purposes only. They are not contractual and may not reflect the exact appearance, specifications, or configuration of the product delivered. Manta Foils reserves the right to make changes to product features, finishes, or design without prior notice, and such variations shall not constitute grounds for return or compensation. These Terms apply to the sale of all Manta Foils-branded products and related components.

This includes but is not limited to:

  • Electric hydrofoils (eFoils: Volt 4, Voyager series)

  • Foil assist propulsion systems (Take Off Air, Take Off Flow)

  • Motors, electronic control units (ECUs), remotes, chargers, and power modules

  • Batteries, mounting hardware, fins, and performance accessories

  • Software, firmware updates, and app integrations provided by Manta Foils

3. Governing Law

These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them, their subject matter or formation, are governed by and construed in accordance with the laws of England and Wales. If you are a consumer resident in the European Union, you additionally benefit from any mandatory provisions of the consumer protection law of your country of residence, and nothing in these Terms affects your rights under such provisions.

4. Pricing and Payment

Property Reservation

All Manta Foils products are sold with a title retention clause. Ownership of the products remains with Manta Foils until full payment of the purchase price and any applicable fees is received. This reservation of title does not affect the transfer of risk, which passes to the Customer upon delivery of the goods to the carrier as described in Section 5. Until ownership is fully transferred, the Customer shall not pledge, resell, or otherwise dispose of the goods without prior written consent from Manta Foils.

  • Prices on the EU shop include VAT for deliveries within the EU. For deliveries outside the EU, prices exclude VAT; customs duties and import taxes are payable by the customer.

  • Orders are processed only upon receipt of full payment. Partial payments will not constitute a valid order.

  • Accepted payment methods include bank transfers, credit cards, and any other method clearly authorized by Manta Foils.

  • Manta Foils reserves the right to cancel orders that remain unpaid after 7 calendar days, unless otherwise agreed in writing.

  • Pricing is subject to change at any time. Confirmed orders will not be affected by subsequent price adjustments.

5. Delivery and Risk Transfer

  • All deliveries are made Ex Works (EXW) from Manta Foils’ designated shipping facility. Title and risk of loss pass to the Customer upon handover to the shipping carrier.

  • Estimated delivery timelines are provided for convenience only and are non-binding. Delivery delays caused by shipping carriers, customs procedures, extreme weather, port strikes, or other unforeseen logistical disruptions are beyond our control.

  • Manta Foils commits to making every reasonable effort to ensure timely delivery and will communicate with the Customer in the event of any material delay.

6. Inspection on Delivery

Upon receiving the shipment, the Customer must inspect all products for damage, shortage, or non-conformity. Claims must be submitted within 3 days of receipt. After this period, the goods are deemed accepted as delivered and in good condition.

7. Right of Withdrawal (EU/EEA Consumers)

If you are a consumer in the EU/EEA, you may withdraw from your purchase within 14 days of receiving the goods, without giving a reason. To exercise this right, notify us at support@mantafoils.com within 14 days of delivery; you then have a further 14 days to send the goods back.

Returned products must be complete and unused beyond what is necessary to inspect them, in their original packaging. You bear the direct cost of the return shipment, and you are liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods. Lithium batteries must be returned in compliance with applicable dangerous-goods shipping regulations (UN 3480/3481).

We will refund all payments received, including standard delivery costs, within 14 days of receiving the returned goods or proof of return shipment, using the original payment method. The right of withdrawal does not apply to products customised to your specifications. Your statutory warranty rights remain unaffected.

8. Software, Firmware & Third-Party Integrations

  • Manta Foils’ products may contain embedded software or firmware essential to functionality.

  • All software and firmware are provided “as-is” and without warranty of compatibility with third-party systems.

  • Manta Foils disclaims all responsibility for issues resulting from unauthorized updates, firmware tampering, or use of aftermarket controllers or apps.

  • Any modifications to software may void warranty coverage.

  • Anonymous usage data may be collected for product improvement and diagnostic purposes, subject to applicable privacy laws.

9. Maintenance Requirements

To retain warranty coverage, customers must follow specific maintenance protocols based on the type of product purchased.

For eFoils (Volt 4, Voyager):

  • A mandatory service every 6 months or 100 hours of use, whichever comes first, must be completed at a certified Manta Foils service center.

  • Proof of service may be requested to validate warranty claims.

  • Failure to adhere to these service intervals voids all warranty obligations.

For Foil Assist Systems (Take Off Air, Flow):

  • Users must ensure thorough cleaning after every use and inspect components regularly.

  • A full service is recommended every 12 months or 100 hours of use.

  • Servicing can be performed at any authorized Manta Foils center or official dealer location.

10. Warranty Summary

Weight Limit Disclaimer:

  • Manta Foils equipment is designed and tested for riders up to 95 kg. Use by individuals exceeding this weight limit may result in compromised performance or product failure. Warranty coverage is not guaranteed above this threshold.

Warranty Coverage:

  • All Manta Foils products are warranted against defects in materials and workmanship for 12 months from the date of shipment.

  • Batteries are covered for 12 months or 300 full charge cycles, whichever occurs first.

Warranty Exclusions:

  • Failure to follow usage and maintenance instructions as outlined in the user manual.

  • Visual irregularities due to manual assembly or cosmetic variations that do not affect product function.

  • Repairs or modifications performed by the Customer or unauthorized third parties.

  • Failure to use protective packaging or original packaging when returning products.

The warranty does not cover:

1.  Normal wear and tear, including deterioration of consumable parts such as seals, props, paint, connectors, or straps.
2.  Damage caused by improper use, accidents, collisions, improper storage, or water ingress due to seal mismanagement.
3.  Environmental damage from exposure to corrosive conditions, extreme temperatures, lightning, or sand.
4.  Unauthorized disassembly, tampering, or modifications including third-party firmware, connectors, or batteries.
5.  Use of the product for rental or commercial purposes without express written consent.

  • Warranties are strictly non-transferable and will not apply to second-hand or resold units, regardless of condition or accompanying documentation.

11. Claim Procedure

If the product was purchased through a dealer, the physical return for warranty repair must be coordinated directly with that dealer. All authorized dealer returns will be handled through the dealer in contact with Manta Foils.
To initiate a warranty claim, the Customer must:

1.  Email support@mantafoils.com with the following information:

– Date and proof of purchase
– Detailed description of the issue
– Supporting photos and/or video clearly showing the defect

2.  Await written confirmation and issuance of a Return Merchandise Authorization (RMA).
3.  Package the product securely and label clearly as: “Warranty Return – No Commercial Value.”
4.  Ship the product to the designated service center at the Customer’s expense. Manta Foils will cover the return shipment of repaired or replaced items.

Claims will be processed within a reasonable time frame. Incomplete or undocumented claims may be delayed or rejected.

12. Repair & Post Warranty Support

  • Any product repair or replacement under warranty does not extend or reset the original warranty period.

  • For issues outside the warranty scope or post-expiration, Manta Foils may offer repair services at standard rates.

  • Customers will be provided a written quote before any repair is initiated.

  • Manta Foils reserves the right to use new, refurbished, or functionally equivalent parts for repairs.

  • Manta Foils shall also not be liable for any incidents, accidents, or bodily harm caused by equipment malfunction, failure, or misperformance, unless directly resulting from a proven manufacturing defect and subject to the terms of the warranty.

15. Entire Agreement

These Terms constitute the entire agreement between Manta Foils and the Customer. No oral representations or prior agreements shall be binding unless incorporated herein. If any provision of these Terms is found unenforceable, the remainder shall continue in full force. No waiver of any breach shall be deemed a waiver of any future breach.
